- Most Americans still don't have an estate plan. Only 24% of American adults reported having a will in 2025 — the lowest rate since tracking began. Without one, state law determines how assets are distributed and, for parents of minor children, who may care for them.
- Trust adoption is accelerating.
LegalZoom's data shows some of the fastest growth in trust adoption is occurring in states with relatively low probate costs. Between H1 2025 and H1 2026, trust adoption surged by over 20 percentage points in states likeIowa (+23.2pp),Kentucky (+23.1pp), andArkansas (+21.7pp). This suggests families are planning not only to reduce expenses but also could be planning to preserve wealth across generations. - Estate planning is becoming increasingly digital. Today, 85% of customers get started with their estate planning on their phones or computers, and half of all
LegalZoom estate plan customers complete the entire process directly from their phone or tablet, reflecting growing consumer demand for convenient, accessible planning tools.
